  • In What Situations Does Illegal Electricity Use Occur?

    According to Article 42 of the Electricity Market Consumer Services Regulation;

    Regarding the place of use of the real or legal person;

    • Consuming electrical energy by intervening in the distribution system without a retail sales contract or bilateral agreement,
    • While there is a retail sales contract or bilateral agreement, intervening in the distribution system by drawing a separate line and consuming electrical energy without being passed through the meter,
    • While there is a retail sales contract or bilateral agreement, interfering with the meters or measurement system, preventing the correct determination of consumption, making incomplete or incorrect measurements, or consuming electrical energy contrary to the legislation by passing it through a meter that is not measured at all or not legally established,
    • The legal entity holding the distribution license must turn on the electrical energy it has cut off in accordance with the relevant legislation, except in cases of force majeure.

    It is considered as illegal electrical energy consumption.

  • In What Situations Does Illegal Electricity Use Occur?

    The consumer;

    • a) Consuming electrical energy outside the scope of its consumer group, without applying to the relevant legal entities,
    • b) Consuming electrical energy by paying the payment notifications issued on behalf of the previous consumer, without having a retail sales contract or bilateral agreement on his/her own behalf,
    • c) Providing electrical energy to third parties from its own electrical installation after the measurement point, except for the provision of the sixth paragraph of Article 6,
    • ç) Even though the power transformer is changed, it does not notify the relevant legal entities in writing within 15 days,
    • d) Except for consumers in the residential consumer group, if the connection power in its own facility or facilities increases by more than twenty percent, it does not apply to the relevant licensed legal entity within the framework of the relevant legislation or fails to fulfill its obligations under the relevant legislation despite having applied,

    In such cases, it is deemed to have consumed electrical energy illegally.

    (2) Regarding the first paragraph; In cases defined in clauses (a), (b) and (c), if an application has been made to the relevant legal entities before detecting irregular electrical energy consumption and this is documented, the provisions regarding irregular electrical energy consumption will not apply.

    (3) In determinations regarding the illegal use of electrical energy defined within the scope of the first paragraph;

    • a) By the suppliers in the case specified in paragraph (b) of the first paragraph, by the responsible supply company in the case specified in paragraph (a),
    • b) By the distribution company in cases specified in paragraphs (c), (d) and (d),

    A cut-off notice is left stating that the consumer is given 15 days to fulfill his obligations. A fee of 5 times the disconnection-connection fee determined by the Board Decision for the year to which the consumer belongs is collected from the consumer group that does not fulfill its obligations, and the electricity is cut off by the distribution company directly in the cases specified in subparagraph (b) of this paragraph, and upon the notification of the responsible supply company in the cases specified in subparagraph (a). The distribution company will inform the relevant supplier about the deductions made within the scope of this article within 2 days.
